KINGSBRIDGE HOMEOWNERS ASSOCIATION, INC. 5K RUN EVENT

General Release, Waiver and Indemnity Agreement

This General Release, Waiver and Indemnity Agreement (the “Agreement”) will confirm that I hereby represent that I know that running and walking in competition is a strenuous and potentially hazardous activity. I understand and assume all risks associated with participating in this event including, but not limited to, falls, contact with other participants, race officials, volunteers, spectators, sponsors or race directors or any of their staff or bystanders, the effects of weather, including snow, ice, rain, heat and/or humidity, traffic, altitude, road and surface conditions, all risks being known and appreciated by me.
I agree to indemnify and hold harmless and defend the Kingsbridge Homeowners Association, Inc. (the “Association”), its agents and assigns, the board of directors, and each member of the board of directors, the property management company, and any of its agents (“Releasees”) from any and all claims resulting from illness (including, but not limited to any form of coronavirus / COVID19), injuries, including death, damage and losses (including legal costs and attorney’s fees) sustained by me and arising out of, connected with, or in any way associated with my participation in this 5K Run Event.
I agree that this Agreement contains the entire agreement between the parties hereto and that the terms of this Agreement are contractual and not a mere recital.
I agree that this Agreement is intended to be as broad as is permitted by the laws of the State of South Carolina. I agree that any disputes relating to this Agreement will be resolved only in a court in Greenville County, South Carolina.
I agree that my participation in this 5K Run Event WILL BE DENIED if my signature, or the signature of my parent/guardian (if I am under the age of 18) does not appear on this Agreement prior to my participation in the 5K Run Event.
I HAVE READ THIS GENERAL RELASE, WAIVER AND INDEMNITY AGREEMENT FULLY AND UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY. I ALSO UNDERSTAND THAT I MAY NOT PARTICIPATE IN THIS 5K RUN EVENT IF I AM UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.
IF YOU ARE A PARENT OR GUARDIAN OF A PARTICIPANT UNDER 18
I, the parent or guardian of the participant (the “Minor”), give my approval for the Minor’s participation in the 5K Run Event. I assume all risks and hazards incidental to the Minor’s participation in the 5K Run Event and I agree to indemnify and hold harmless and defend the Releasees from any and all claims resulting from illness (including, but not limited to any form of coronavirus / COVID-19), injuries, including death, damage and losses (including legal costs and attorney’s fees) sustained by the Minor and arising out of, connected with, or in any way associated
with the Minor’s participation in this 5K Run Event. I consent to the foregoing and grant permission for the Minor to participate in this 5K Run Event. I HAVE READ THIS GENERAL RELASE, WAIVER AND INDEMNITY AGREEMENT FULLY AND UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY.
